Wicker Park area couple drops ‘Windy City Rehab’ fraud lawsuit after reaching settlement

The couple said in the suit that defects were not repaired or paid for as promised. The couple noted a sloped front patio, corroding gas pipes, a sewage odor in the furnace room and basement mold, among other issues. The homebuyers said in their suit that their warranty provides that the “seller will cause to be corrected any defect due to faulty construction and/or defective materials brought to seller’s attention by written notice for one year from the date of closing.” Leaks, material defects and water-related problems were not disclosed before the April 2019 closing, according to the suit, and rainwater seeped into the home later that month.
